The sad news of Jennifer Aniston and Justin Theroux’s separation has led to much speculation about how they may split their significant wealth. The press has reported that Jennifer and Justin signed a prenuptial agreement before they married. Presuming this is true the division of their assets should be quite clear.
In this country prenuptial agreements are not binding, but following some recent cases are likely to be followed if the result is fair and various conditions met including that the parties had exchanged full financial disclosure and both had independent legal legal advice. The prenuptial agreement must be signed in good time before the wedding, preferably several months before.
Without an agreement couples such as Jen and Justin may have significant legal arguments about “needs” and “sharing”.
