This is the first time a case like this has been before the Court of Appeal and how the court deal with it will be watched closely by family lawyers.
Helen Roocroft, 40, claims her tycoon ex, Carol Ann Ainscow, who died in 2013, misled her about her wealth when they split. Granting permission for what is thought to be the first lesbian "divorce" to reach the Court of Appeal, Lady Justice Black said Ms Roocroft's case is unique. "The complication of the death of Ms Ainscow is significant," she said. "I'm not aware of any similar case where the non-disclosure has been acted upon following death of the other party."
